1. Introduction

This Privacy Policy explains how Robichaux Law Firm (“Robichaux Law Firm,” “the Firm,” “we,” “us,” or “our”) collects, uses, discloses, and protects information about visitors to DUIDefenseSavannah.com (the “Site”).

We are a criminal defense law practice based in Savannah, Georgia, serving clients throughout Chatham, Bryan, Effingham, and surrounding counties. We take the privacy of the people who contact us seriously. If you have questions about anything in this policy, contact us using the details in Section 20.

By using the Site, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.

2. Important Notice: No Attorney-Client Relationship

Reading this Site, submitting a form, calling, texting, or emailing us does not create an attorney-client relationship. An attorney-client relationship is formed only when the Firm and a client sign a written engagement agreement.

Do not send confidential or time-sensitive case details through the Site’s forms, by unencrypted email, or by text message. Information you send before an attorney-client relationship exists may not be protected by attorney-client privilege, and we may not be able to treat it as confidential. If you need to discuss the specifics of your case, call us and speak with an attorney.

Nothing on this Site is legal advice. Prior case results do not guarantee a similar outcome in your matter.

3. Scope of This Policy

This Privacy Policy applies to information collected through DUIDefenseSavannah.com and through the phone, text, email, and form channels connected to it.

It does not apply to:

  • Information governed by the attorney-client relationship, our engagement agreements, and applicable rules of professional conduct, including the Georgia Rules of Professional Conduct. Where those rules or an engagement agreement impose stricter confidentiality obligations, those obligations control.
  • Third-party websites, social media pages, directories, or review platforms that we link to or that link to us. Those services have their own privacy policies.
  • Information collected offline in ways unrelated to the Site.

4. Information We Collect

4.1 Information You Provide Directly

Our contact form. The form on our contact page asks for four things:

  • Name
  • Phone number
  • Email address
  • A brief description of your case

That is all we ask for. We do not request a mailing address, date of birth, Social Security number, driver’s license number, or any document upload through the Site.

Other ways you reach us. You may also call our office, send us a text message, or email us. In those cases we receive your phone number or email address along with whatever you choose to tell us.

The case description field is free text, and whatever you type there is stored with your submission. Please keep it brief and general. See Section 2 before you describe the specifics of a pending charge.

4.2 Information Collected Automatically

When you visit the Site, certain information is collected automatically through cookies, pixels, tags, software development kits, and similar technologies:

  • Device and technical data: IP address, browser type and version, operating system, device type, screen resolution, and language settings
  • Usage data: pages viewed, time on page, scroll depth, clicks, referring URL, exit pages, and the search terms or ad that brought you to the Site
  • Approximate location: a general geographic area derived from your IP address, typically city or region level, not precise GPS location
  • Session activity: mouse movement, scrolling, and click patterns captured as part of heatmap and session analysis (see Section 4.4)
  • Advertising identifiers: cookie identifiers and click identifiers such as Google Click Identifier (GCLID) and Facebook Click Identifier (FBCLID) used to attribute a visit to an advertisement

4.3 Call Tracking

We use CallTrackingMetrics, a third-party call analytics service, to understand which marketing channels generate calls to the Firm. Phone numbers displayed on the Site may be tracking numbers that forward to our office.

Through this service we may collect:

  • The caller’s phone number and, where available, general caller location
  • Date, time, and duration of the call
  • The marketing source, campaign, keyword, or web page associated with the call
  • Voicemail messages you leave
  • Text messages sent to or from a tracking number

Call recording is disabled by default on our tracking numbers. If recording is enabled for a particular line at any point, callers will hear a notice at the start of the call and will be given the opportunity to consent or to end the call. Georgia is a one-party consent state, but we provide notice as a matter of practice, and some callers may be located in states requiring all-party consent.

Call detail records may be retained by CallTrackingMetrics under its own retention schedule. See callTrackingMetrics.com for its privacy practices.

4.4 Session Replay and Heatmaps

We use Microsoft Clarity to produce heatmaps and behavioral analytics that help us improve the Site’s usability. Clarity captures pseudonymous interaction data such as clicks, scrolls, mouse movement, and page transitions. Clarity sets its own first-party cookies and collects your IP address, approximate location, and browser user agent. It does not identify you by name.

Form fields are masked. Clarity is configured so that text you type into forms, including your name, phone number, email address, and message, is not captured or transmitted. We have enabled masking on input fields and sensitive page content.

Microsoft may use the data it collects through Clarity in accordance with the Microsoft Privacy Statement. See privacy.microsoft.com for details.

4.5 Information From Third Parties

We may receive information about you from:

  • Advertising and analytics platforms, including Google and Meta, in aggregated or pseudonymous form, describing ad performance and audience characteristics
  • Legal directories and referral sources, if you contacted us through a third-party listing or a referring attorney
  • Publicly available records, in the course of evaluating or handling a legal matter, subject to our professional obligations
  • Service providers that support our website, intake, scheduling, or communications

4.6 Sensitive Information

Some of what you may tell us, including the fact that you are seeking criminal defense representation, is understandably sensitive. We do not sell this information, and we do not use it to build advertising profiles about you.

We do not transmit the substance of your inquiry to any advertising platform. One limitation is worth stating plainly: our call tracking provider stores the marketing source of a call in the same record as any voicemail or text message content associated with that call. That record is used to route and log the contact and to measure marketing performance. It is not shared with advertising platforms, and the content of your message is not used to target advertising to you.

We do not knowingly collect Social Security numbers, financial account numbers, government identification numbers, precise geolocation, biometric data, or health information through the Site. Please do not submit these through web forms.

5. Cookies, Tags, and Similar Technologies

5.1 What We Use

We deploy tags and cookies through Google Tag Manager, a tag management system that controls when and whether other tracking technologies load on the Site. Google Tag Manager sets no cookies of its own and collects no information beyond what any web request necessarily transmits, such as your IP address and browser type. It governs the tools listed below.

CategoryPurposeTechnologies usedLoads without consent?
Strictly necessarySite security, load balancing, form submission and spam prevention, remembering your consent choicesHosting and security cookies, consent management platform cookie, form and spam-protection cookiesYes. These are required for the Site to function and cannot be switched off.
Analytics and performanceMeasuring traffic, understanding how pages are used, diagnosing usability problemsGoogle Analytics 4, Microsoft ClarityNo. These load only after you accept the analytics category.
Advertising and marketingMeasuring ad performance, attributing calls and form fills to a campaign, showing relevant ads on other platforms, remarketingGoogle Ads conversion tracking and remarketing tags, Meta Pixel, CallTrackingMetrics dynamic number insertionNo. These load only after you accept the advertising category.

CallTrackingMetrics appears in the advertising category because its purpose is to attribute a call to the campaign that produced it. If you decline the advertising category, the dynamic number insertion script does not load and the Site displays our standard office number instead. You can always call us.

Cookies may be session cookies, which expire when you close your browser, or persistent cookies, which remain until they expire or you delete them. Retention periods vary by vendor and generally range from a single session to twenty-four months.

5.2 Consent Banner and Managing Your Preferences

When you first visit the Site, a consent banner allows you to accept all cookies, reject non-essential cookies, or open preferences and choose by category. Your choice is stored so you are not asked on every page.

You can change your choice at any time by selecting “Cookie Preferences” in the Site footer. The footer also carries a “Do Not Sell or Share My Personal Information” link, which submits an opt-out that applies to the advertising technologies described in Section 6 and to any other activity that qualifies as a sale or share.

Analytics and advertising technologies are switched off by default for every visitor. They do not load until you accept the relevant category. We implement Google Consent Mode v2, with consent for analytics storage, ad storage, ad user data, and ad personalization all set to denied until you choose otherwise.

You can also control cookies through your browser settings. Blocking all cookies may prevent parts of the Site from working correctly.

5.2.1 Do Not Track

Some browsers offer a “Do Not Track” (DNT) setting. There is no industry standard for how a website should respond to a DNT signal, and we do not currently respond to DNT signals. We do honor the Global Privacy Control signal described below, which is a recognized opt-out preference signal.

5.3 Global Privacy Control

We honor the Global Privacy Control (GPC) browser signal. If your browser or extension transmits a GPC signal, we treat it as a request to opt out of the sale or sharing of personal information and of targeted advertising. We apply the opt-out to that browser and device, and where we can reasonably associate the signal with a person we already have a record of, we apply it to that person as well. Because the signal is device-specific, enable it on each browser and device you use.

6. Advertising and Analytics Partners

6.1 Google Analytics 4

We use Google Analytics 4 to understand aggregate Site usage. Google Analytics uses cookies and similar identifiers to generate reports on visitor behavior. Google Analytics 4 does not log or store IP addresses; an IP address is used transiently to derive an approximate location and is then discarded. We do not use Google Analytics to identify individual visitors by name, and we do not upload form content to it.

You may opt out across all sites using the Google Analytics Opt-out Browser Add-on, available at tools.google.com/dlpage/gaoptout.

6.2 Google Ads

We run search and display advertising through Google Ads. Google Ads conversion tracking tags record when a Site visit leads to a call or form submission, and remarketing tags allow us to show ads to people who have previously visited the Site.

You can manage the ads you see and turn off ad personalization at myadcenter.google.com.

6.3 Meta Pixel

We use the Meta Pixel (Facebook and Instagram) to measure the performance of social advertising and, where applicable, to reach past visitors with follow-up advertising. The pixel sends Meta information about pages viewed and actions taken on the Site, associated with a Meta identifier where you are logged into a Meta service.

Because of the sensitivity of criminal defense inquiries, we do not use the Meta Pixel to build audiences based on the substance of a case inquiry, and we do not transmit case details to Meta.

You can control ad personalization through Meta’s Accounts Center, at accountscenter.facebook.com/ad_preferences.

6.4 Industry Opt-Out Tools

You may also opt out of interest-based advertising from participating companies at:

  • Digital Advertising Alliance: optout.aboutads.info
  • Network Advertising Initiative: optout.networkadvertising.org
  • For mobile apps: the AppChoices app from the Digital Advertising Alliance

Opting out stops personalized ads. It does not stop ads altogether, and it does not delete data already collected.

7. Text Messaging (SMS) Communications

7.1 Consent

If you provide your mobile number and opt in, we may contact you by text message about your inquiry, consultation scheduling, court dates, and case updates.

How we obtain consent. Written consent is obtained through an explicit, unchecked opt-in box on our forms, or by you texting one of our published numbers first. Verbal permission given during a call covers informational and transactional messages only, meaning messages about a matter you have already contacted us about. We do not send promotional or marketing text messages without your prior express written consent.

Consent to receive text messages is not a condition of retaining the Firm or of receiving any legal service.

7.2 What to Expect

  • Message frequency varies based on your matter and your inquiry.
  • Message and data rates may apply. Check with your mobile carrier.
  • Carriers are not liable for delayed or undelivered messages.
  • Text messaging is not a secure or confidential channel. Do not send case details, admissions, or sensitive information by text.

7.3 Opting Out and Getting Help

  • Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message to stop receiving texts from that number. You will receive one confirmation message, and no further messages will be sent to that number.
  • Reply HELP for assistance. You will receive a message identifying the Firm and giving you our phone number.
  • You may revoke consent by any reasonable means, including by replying in your own words, telling us by phone, or emailing us using the details in Section 20. We will honor a revocation promptly and in any event within the period required by law.

7.4 No Sharing of Consent Data

Mobile phone numbers and text messaging consent are not sold, rented, or shared with third parties or affiliates for their own marketing purposes. We share mobile numbers only with the messaging service providers that transmit messages on our behalf, and only to deliver those messages.

8. How We Use Your Information

We use the information described above to:

  • Respond to your inquiry and evaluate whether we can assist with your matter
  • Schedule and conduct consultations
  • Communicate with you about your matter by phone, text, email, or mail, consistent with your preferences
  • Perform conflict-of-interest checks
  • Provide legal services if you become a client
  • Operate, secure, maintain, and improve the Site
  • Analyze how visitors find and use the Site so we can improve navigation, content, and page performance
  • Measure the effectiveness of our advertising and allocate marketing spend
  • Detect, prevent, and respond to fraud, spam, abuse, and security incidents
  • Comply with legal, regulatory, ethical, and professional obligations, including record retention rules applicable to attorneys
  • Establish, exercise, or defend legal claims

We do not use automated decision-making that produces legal or similarly significant effects about you, and we do not profile visitors for that purpose.

9. How We Share Your Information

We do not sell your personal information. We do not disclose it to anyone in exchange for money or other valuable consideration.

Some of the advertising and analytics technologies described in Sections 5 and 6 may constitute “sharing” for cross-context behavioral advertising or “targeted advertising” under certain state privacy laws. You can opt out as described in Sections 5.2, 5.3, 6, and 11.

We may disclose information in these circumstances:

Service providers and processors. Vendors that perform functions on our behalf under contract, including website hosting, form processing, workflow automation, lead tracking, email delivery, call tracking, text messaging, analytics, scheduling, document management, and IT support. They are permitted to use the information only to provide services to us.

Specifically, when you submit our contact form, the four fields you completed are transmitted through an automation service to a lead tracking record and to our client intake system, so that someone at the Firm sees your inquiry and can respond to it. Your case description travels with that record. These systems are access-controlled and are used to respond to you and to manage intake, not for advertising.

Advertising and analytics platforms. Google and Meta, as described in Section 6, subject to your consent choices.

Co-counsel, experts, and vendors in a legal matter. If you become a client, we may share information as reasonably necessary to represent you, including with investigators, expert witnesses, court reporters, and co-counsel, consistent with our professional obligations and your instructions.

Courts, prosecutors, and other parties. As required to represent you in your matter.

Legal compliance and protection. When required by law, subpoena, court order, or governmental request; to enforce our terms; to protect the rights, property, or safety of the Firm, our clients, or others; or as permitted or required by the Georgia Rules of Professional Conduct.

Business transfers. In connection with a merger, dissolution, sale of practice assets, or similar transaction, subject to the ethical rules governing the sale of a law practice and to appropriate confidentiality protections.

With your direction or consent. Where you ask or authorize us to share information.

10. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, and to satisfy our legal, ethical, and professional obligations.

  • Inquiries that do not result in representation are generally retained for a limited period sufficient to run conflict checks and to document the contact, then deleted or archived. This includes the lead tracking record created when you submit the contact form.
  • Client files are retained in accordance with the Georgia Rules of Professional Conduct, our engagement agreement, and applicable file retention requirements.
  • Analytics data. Google Analytics 4 event data retention is set to 14 months. Microsoft Clarity retains session recordings for thirty days from the time of recording. Two categories run longer: a randomly selected sample of recordings, and any recording our team marks as a favorite, are retained for up to nine months. Heatmap data is available for up to nine months. These periods are set by Microsoft rather than by us, and Microsoft may change them.
  • Advertising data is retained according to the settings we configure in each platform and each vendor’s own schedule.
  • Call records are retained per our CallTrackingMetrics configuration.

When information is no longer needed, we delete it or de-identify it.

11. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding personal information we hold about you:

  • Right to know or access: confirm whether we process your personal information and obtain a copy
  • Right to correct: ask us to fix inaccurate personal information
  • Right to delete: ask us to delete personal information we collected from you
  • Right to portability: receive your information in a portable format
  • Right to opt out of the sale or sharing of personal information, of targeted advertising, and of certain profiling
  • Right to limit the use and disclosure of sensitive personal information. We already limit our use of sensitive personal information to providing the legal services you asked about and to purposes the law permits without a request. We do not use it to infer characteristics about you, we do not disclose it for cross-context behavioral advertising, and we do not sell it. For that reason we do not display a separate “Limit the Use of My Sensitive Personal Information” link. If you want to make a request anyway, use the process in Section 11.1.
  • Right to non-discrimination: we will not deny services, charge different prices, or provide a different level of service because you exercised a privacy right
  • Right to appeal a decision we make on your request, where your state provides one

These rights are subject to exceptions. In particular, information that is part of a client file, is subject to attorney-client privilege or the work product doctrine, or that we are required to retain under professional conduct or record retention rules may be exempt from deletion.

11.1 How to Submit a Request

Send your request to us using any of the methods in Section 20, with “Privacy Request” in the subject line. Tell us which right you are exercising and give us enough information to locate your records.

Verification. To protect your information, we will take reasonable steps to verify your identity before acting. We may ask you to confirm details that match our records. We will not use verification information for any other purpose.

Timing. We will respond within the timeframe required by applicable law, generally within forty-five days, and we may extend that period where permitted by giving you notice.

Authorized agents. You may use an authorized agent to submit a request. We may require written authorization from you and verification of the agent’s identity.

Appeals. If we decline your request and your state provides an appeal right, you may appeal by replying to our response with the word “Appeal” and your reason. We will respond in writing within the period your state requires. If your appeal is denied, you may contact your state Attorney General.

12. Additional Information for California Residents

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, provides the rights described in Section 11 plus the disclosures below.

12.1 Categories of Personal Information

Sensitive personal information. The content of your communications with us, including a description of a criminal matter, may be treated as sensitive personal information. We use it only to respond to your inquiry and provide legal services. We do not use or disclose sensitive personal information for purposes of inferring characteristics about you, and we do not sell it.

We do not knowingly collect or sell the personal information of consumers under sixteen years of age.

12.2 Sale and Sharing

We do not sell personal information, meaning we do not disclose it for money or other valuable consideration.

Our use of the advertising technologies described in Section 6 may be considered “sharing” for cross-context behavioral advertising. In addition, Microsoft may use data collected through Clarity for its own purposes under the Microsoft Privacy Statement, which means our use of Clarity may also fall within the definition of a sale or share.

You may opt out of all of it by:

  • Selecting “Do Not Sell or Share My Personal Information” in the Site footer
  • Selecting “Cookie Preferences” in the Site footer and declining the analytics and advertising categories
  • Transmitting a Global Privacy Control signal from your browser
  • Contacting us using the details in Section 20

12.3 Shine the Light

California Civil Code Section 1798.83 permits California residents to request information about disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

13. Additional Information for Other State Residents

If you are a resident of a state with a comprehensive consumer data privacy law, including but not limited to Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Florida, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, and Maryland, you have the rights described in Section 11 to the extent your state’s law applies to us.

Georgia has not enacted a comprehensive consumer data privacy statute as of the effective date of this policy. We extend the request process in Section 11 to Georgia residents as a matter of practice.

Some of these laws apply only to businesses meeting certain volume thresholds. Where a law does not apply to us, we will still make a good faith effort to honor reasonable requests.

13.1 Nevada Residents

Nevada Revised Statutes Chapter 603A gives Nevada consumers the right to direct a website operator not to sell certain covered information. We do not sell covered information as Nevada defines it. If you are a Nevada resident and wish to submit a verified request regarding the sale of your covered information, email us at the privacy address in Section 20 with “Nevada Opt-Out” in the subject line.

14. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, disclosure, alteration, and destruction. These include encryption in transit using TLS, access controls, and vendor due diligence.

No method of transmission or storage is completely secure. We cannot guarantee absolute security. Please see Section 2 regarding the confidentiality of information sent before an attorney-client relationship exists.

If we become aware of a breach affecting your personal information, we will notify you and applicable regulators as required by law.

15. Where Your Information Is Processed

We are located in the United States, and the information we collect is processed and stored in the United States. Some of our service providers may process information in other countries. If you access the Site from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.

Our services are directed to individuals with legal matters in Georgia and are not intended for residents of the European Economic Area or the United Kingdom.

16. Children’s Privacy

The Site is not directed to children under thirteen, and we do not knowingly collect personal information from children under thirteen. If you believe a child has provided us with personal information, contact us and we will delete it.

If a parent or guardian is contacting us about a matter involving a minor, please call our office rather than submitting details through the Site.

17. Third-Party Websites and Links

The Site may link to third-party websites, legal directories, review platforms, court resources, and social media profiles. We do not control those sites and are not responsible for their content or privacy practices. Review the privacy policy of any site you visit.

18. Your Communication Choices

  • Email: you may unsubscribe from marketing emails using the link in any such message, or by contacting us. We will still send messages necessary to your matter if you are a client.
  • Text messages: reply STOP as described in Section 7.
  • Phone: tell us at any time that you prefer not to be called.
  • Cookies and tracking: use the Cookie Preferences link in the footer, your browser settings, Global Privacy Control, or the opt-out tools in Section 6.

19. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices, technology, or the law. When we do, we will revise the “Last Updated” date at the top of this page. If the changes are material, we will provide more prominent notice, such as a Site banner.

We encourage you to review this page periodically.
